Acceptable Use Policy

The rules that keep the ResortConcierge AI platform safe, secure, and reliable for every hotel, resort, and guest.

This Acceptable Use Policy (the "AUP" or "Policy") governs use of the ResortConcierge AI websites, applications, dashboards, APIs, integrations, documentation, and related services (the "Service") provided by Anchor Point Agency, LLC, a limited liability company organized under the laws of the State of South Carolina, United States, doing business as ResortConcierge AI ("ResortConcierge," "we," "us," or "our"). The AUP is incorporated into and forms part of our Terms of Service, and capitalized terms not defined here have the meanings given there. It applies to every Customer, Authorized User, and other person who accesses or uses the Service, and it exists to protect guests, customers, the public, and the integrity of the Service. You are responsible for ensuring that your Authorized Users — and the guest-facing experiences you configure — comply with this Policy and all applicable laws. Where you and ResortConcierge have a separately signed Order that addresses acceptable use, that Order controls to the extent it conflicts with this Policy for the subject it covers.

1. Scope & application

This Policy applies to all use of the Service and to all content, data, and communications transmitted through it. It supplements, and does not limit, the obligations in the Terms of Service and any applicable laws.

  • You are responsible for all activity under your account and your Authorized Users' credentials, and for the guest-facing experiences you configure.
  • You must ensure your Authorized Users are aware of and comply with this Policy.
  • You remain responsible for the content of your knowledge base, configurations, and any data you load into or generate through the Service.
  • Compliance with this Policy is a condition of your continued access to and use of the Service.

2. General principles

Use the Service lawfully, honestly, and respectfully. In short, do not use the Service in any way that is unlawful, harmful, deceptive, or that infringes the rights of others or endangers the security, availability, or integrity of the Service.

3. Prohibited content

You and your Authorized Users must not use the Service to create, upload, store, transmit, or make available content that:

  • Is unlawful, infringing, defamatory, obscene, harassing, threatening, hateful, or otherwise objectionable.
  • Infringes or misappropriates any intellectual property, privacy, publicity, or other right of any person.
  • Contains malware, ransomware, or other malicious or harmful code.
  • Exploits, sexualizes, or endangers minors, or facilitates human trafficking or exploitation.
  • Promotes or facilitates violence, terrorism, self-harm, or illegal activity.
  • Is fraudulent, deceptive, or misleading, including impersonating any person or misrepresenting your affiliation.
  • Contains personal data or special-category data you are not authorized to process, or that you have no lawful basis to provide.

4. Prohibited activities & system integrity

You and your Authorized Users must not engage in activity that compromises the security, integrity, availability, or performance of the Service, or that abuses or circumvents its controls. Without limitation, you must not:

  • Attempt to gain unauthorized access to the Service, other accounts, or our systems or networks.
  • Probe, scan, or test the vulnerability of the Service, or breach or circumvent security or authentication measures, without our prior written authorization.
  • Introduce malware or malicious code, or interfere with or disrupt the integrity or performance of the Service or the data it contains.
  • Circumvent or exceed usage limits, Credits, rate limits, quotas, or access controls.
  • Reverse engineer, decompile, disassemble, scrape, or copy the Service, or use the Service or AI Output to build or train a competing product or model, except where this restriction is prohibited by law.
  • Resell, sublicense, time-share, or provide the Service to third parties except as expressly permitted in your Order.
  • Use automated means in a way that imposes an unreasonable or disproportionate load on the Service or that interferes with other customers' use.
  • Remove, obscure, or alter any proprietary notices, or misrepresent the source or ownership of the Service or AI Output.

5. Messaging, anti-spam & communications

When you use the Service to communicate with guests or others, you must comply with all applicable communications, consent, and anti-spam laws, including, where applicable, the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and similar laws in other jurisdictions.

  • Obtain all required consents before sending messages, and honor opt-out and do-not-contact requests promptly.
  • Do not send spam, bulk unsolicited messages, or deceptive, misleading, or abusive communications.
  • Accurately identify yourself as the sender and provide required disclosures and unsubscribe mechanisms where applicable.
  • Do not use the Service to send communications you are not authorized to send or that target individuals who have not consented.

6. Responsible use of AI

The Service's AI concierge and related features should be used to serve guests honestly, accurately, and respectfully. AI Output may be inaccurate or incomplete and requires human oversight; you are responsible for how you configure and deploy it.

  • Maintain appropriate human review of AI Output before it is relied upon or sent to guests, and do not present AI Output as professional, legal, medical, or financial advice.
  • Do not configure or use AI features to generate unlawful, harmful, discriminatory, deceptive, or misleading content.
  • Provide accurate, lawful knowledge-base content and guardrails appropriate to your property, and keep them current.
  • Comply with applicable laws regarding disclosure of AI interactions, and do not use the Service to deceive guests about whether they are interacting with automated systems where disclosure is required.
  • Do not attempt to manipulate the AI to bypass safety controls, generate prohibited content, or extract another party's confidential or personal data.

7. Data responsibilities

You are responsible for the data you process through the Service. You must have all rights, consents, and legal bases necessary for us to process Customer Data, including guest data, on your behalf, and you must provide all required privacy notices to your guests and Authorized Users. Do not load data into the Service that you are not authorized to process, and configure the Service's privacy, retention, and access controls appropriately for your obligations. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Agreement.

8. Third-party services & integrations

When you connect third-party services — such as property management systems, messaging channels, payment processors, or AI providers — you must comply with those providers' terms and use the integrations only as authorized. You are responsible for the data you exchange through integrations and for ensuring your use does not violate any third party's rights or this Policy. We are not responsible for third-party services or their handling of data.

9. Reporting violations

If you become aware of any actual or suspected violation of this Policy, a security vulnerability, or abuse of the Service, please report it to Anchor Point Agency, LLC through our contact page with enough detail for us to investigate. We appreciate good-faith reports and will review them promptly. Do not test or exploit a suspected vulnerability beyond what is necessary to demonstrate it, and do not access or alter data that is not yours.

10. Enforcement & consequences

We may monitor for, investigate, and respond to suspected violations of this Policy, and we may take action we consider appropriate and proportionate to protect the Service, our users, guests, and third parties.

  • We may investigate suspected violations and request information reasonably needed to assess them.
  • We may remove or disable access to violating content or configurations.
  • We may throttle, suspend, or restrict access to all or part of the Service.
  • Serious, repeated, or unresolved violations may lead to suspension or termination of your account in accordance with the Terms of Service.
  • We aim to give notice where practical, but we may act immediately — including without prior notice — where necessary to protect the Service, prevent harm, or comply with law.
  • We may cooperate with law enforcement and disclose information where required by law or legal process.

11. Changes to this Policy

We may update this Policy from time to time to address new risks, features, or legal requirements. When we make material changes, we will update the "Last updated" date below and provide notice where required by law or your Order. Changes take effect when posted unless stated otherwise, and your continued use of the Service after a change takes effect constitutes acceptance of the updated Policy.
